Privacy Policy

("Colibrì Jets", "we", "us") is the controller responsible for the personal data described in this Privacy Policy.

1. Who We Are and How to Contact Us

Colibrì Jets is an independent air charter broker registered in the Netherlands. For any question about this Privacy Policy or about how we handle your personal data, you can contact us at Kyle.Samson@colibrijets.com or at our registered address above.

2. What Personal Data We Collect

Depending on your interaction with us, we may collect: (a) identity and contact details, such as your name, email address, phone number, and billing address; (b) booking and travel details, such as passenger names, dates of birth, passport or identity document details where required for a flight, itinerary information, and any special requirements relating to your booking; (c) payment-related information, such as billing details and invoicing records (Colibrì Jets does not itself process or store card payment details, as the Charterer pays the Operating Carrier directly); (d) communications, such as emails, messages, and call notes arising from your enquiry or booking; and (e) website usage data collected via cookies and similar technologies, such as pages visited and general analytics information, as described in Section 9 below.

Where you choose to share it, we may also keep a record of your personal preferences for future bookings, such as dietary requirements, accessibility needs, or other health-related preferences, so that we can provide a more personalised service on repeat bookings without needing to ask you again each time. This information may constitute a special category of personal data under the GDPR. We only collect and retain it with your explicit consent, which you may withdraw at any time, and declining to provide it will not affect your ability to make a booking.

Some data is optional, such as marketing preferences or the personal preferences described above. However, providing your identity and travel document details (such as your full name, date of birth, and passport or identity document details) is necessary in order for us to arrange your charter booking, as Operating Carriers are legally required to hold this information to perform the flight. If you do not provide this information, we will not be able to complete your booking.

3. Why We Collect It and Our Legal Basis

We process personal data for the following purposes, each with a corresponding legal basis under the General Data Protection Regulation ("GDPR"): (a) to provide quotations and arrange charter bookings, and to communicate with Operating Carriers and suppliers on your behalf, on the basis that this is necessary for the performance of a contract with you or to take steps at your request prior to entering into one; (b) to comply with legal obligations, such as retaining invoicing records for tax purposes, or complying with sanctions, anti-money-laundering, and aviation security requirements, on the basis of legal obligation; (c) to communicate with you about your enquiry or booking, and to maintain the security and proper functioning of our business, on the basis of our legitimate interests, balanced against your rights; and (d) where you have separately agreed, to send you marketing communications or to use non-essential analytics cookies, on the basis of your consent, which you may withdraw at any time; and (e) to record and retain your dietary, accessibility, or other health-related preferences for use in future bookings, so as to provide a more personalised service, on the basis of your explicit consent, which you may withdraw at any time by contacting us, without affecting the lawfulness of processing before withdrawal.

4. Who We Share Your Data With

We share personal data with Operating Carriers, so that they can perform the flight and comply with their own regulatory obligations; with Ancillary Service suppliers you have asked us to arrange, such as ground transport or catering providers, limited to what is needed to deliver that service; with professional advisers, such as accountants or lawyers, where necessary; with regulators, tax authorities, or law enforcement where required by law; and with IT and service providers who support our business operations (for example, email, invoicing, website hosting, or website analytics providers), acting under appropriate confidentiality and data protection safeguards. We do not sell personal data to third parties.

5. International Transfers

Where an Operating Carrier or supplier is located outside the European Economic Area, your personal data may be transferred to that country. Where this occurs, we take steps to ensure an adequate level of protection, such as relying on an applicable adequacy decision by the European Commission, or putting in place Standard Contractual Clauses approved by the European Commission, or another safeguard recognised under the GDPR. You may contact us for further information about the safeguards applicable to a specific transfer.

6. How Long We Keep Your Data

We retain personal data for as long as necessary for the purposes described in this Policy. As a general guide: booking and passenger data is generally retained for the duration of the contractual relationship and for a period afterwards to meet legal, tax, insurance, and potential dispute-related obligations, ordinarily up to 7 years from the end of the relevant financial year, consistent with Dutch tax record-keeping requirements; marketing consents are retained until withdrawn; website analytics data is retained only for the period necessary for the analytics purpose, after which it is deleted or anonymised; and dietary, accessibility, or other health-related preferences you have shared with us under Section 3(e) above are retained only for as long as necessary to provide you with a personalised service on future bookings, and in any event only until you withdraw your consent, whichever is earlier.

7. Your Rights

Subject to the conditions and exemptions under applicable law, you have the right to: request access to the personal data we hold about you; request rectification of inaccurate data; request erasure of your data; request restriction of processing; object to processing based on legitimate interests or for direct marketing; request data portability; and withdraw consent at any time where processing is based on consent, without affecting the lawfulness of processing before withdrawal. To exercise any of these rights, please contact us using the details in Section 1. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) or another competent supervisory authority.

8. Security

We implement appropriate technical and organisational measures designed to protect personal data against unauthorised access, loss, misuse, or alteration, proportionate to the nature and sensitivity of the data concerned. No method of transmission or storage is completely secure, and we cannot guarantee absolute security, but we take reasonable steps appropriate to a business of our size and activities.

9. Cookies and Similar Technologies

Our website may use cookies and similar technologies for purposes that may include essential site functionality and analytics, so that we can understand how visitors use our site. Where analytics or other non-essential cookies are used, we will request your consent through a cookie banner before such cookies are set, and you may change or withdraw your preferences at any time through that banner or through your browser settings. Declining non-essential cookies will not affect your ability to use our website or to make a booking enquiry.

10. Changes to This Policy

We may update this Privacy Policy from time to time, for example to reflect changes in our practices or in applicable law. The updated version will be published at the same website address, together with the date it takes effect. We encourage you to review this Policy periodically.

Where we make a material change, such as starting to collect a new category of personal data or using your data for a materially different purpose, we will take reasonable steps to notify you directly, for example by email, in addition to updating this Policy online, and, where the change relates to processing based on your consent, we will seek your fresh consent before relying on it.
